Terms of Use
1. Agreement
These Terms of Use govern your use of the RhythmKeep iOS application and rhythmkeep.com, provided by DonsonlineStoreLLC ("RhythmKeep," "we," "us," or "our"). By using RhythmKeep, you agree to these terms and Apple’s applicable terms. If you do not agree, do not use RhythmKeep.
2. Eligibility
You must be legally permitted to use RhythmKeep and enter into these terms. If you use RhythmKeep for an organization, you represent that you have authority to do so.
3. RhythmKeep’s purpose
RhythmKeep helps users organize routines, recurring responsibilities, and reminders. It is a general organizational tool and does not guarantee that any reminder will be delivered, seen, or completed.
4. Health and safety notice
RhythmKeep is not a medical device, emergency service, or substitute for professional medical, legal, financial, safety, or other advice. Do not rely on it as the sole means of remembering medication, treatment, emergencies, deadlines, maintenance, or other safety-critical activities. Use independent safeguards and seek qualified advice when appropriate.
5. Your responsibilities
- Use RhythmKeep only for lawful purposes.
- Keep your device, Apple Account, and exported backup files secure.
- Maintain appropriate independent records and safeguards for important information.
- Do not interfere with, misuse, copy, reverse engineer, or attempt unauthorized access to RhythmKeep except where applicable law expressly permits it.
6. Free features and RhythmKeep Pro
RhythmKeep may offer free features and optional automatically renewing RhythmKeep Pro subscriptions. Before purchase, the app displays the subscription duration, localized price, included features, and renewal information supplied by Apple. Payment is charged to your Apple Account after confirmation. Unless canceled, a subscription renews automatically according to the terms shown by Apple. You can manage or cancel subscriptions in your Apple Account settings. Cancellation takes effect at the end of the current paid period. Apple handles billing, refunds, taxes, and payment disputes under its applicable policies. Features and prices may change as permitted by Apple and applicable law.
7. Ownership and license
RhythmKeep, including its software, design, branding, and original content, is owned by DonsonlineStoreLLC or its licensors and is protected by applicable law. Subject to these terms, you receive a limited, personal, revocable, nonexclusive, nontransferable license to use the app for your own lawful purposes.
8. Your content and backups
You retain ownership of the routines and other content you create. Core app data is stored locally on your device. You are responsible for maintaining any backup you need and for protecting exported backup files. We cannot retrieve local data that is lost or deleted.
9. Feedback
If you voluntarily provide ideas or feedback, you grant us permission to use them without restriction or compensation, while we remain free not to use them.
10. Availability and changes
We may update, modify, suspend, or discontinue features when reasonably necessary. We do not promise that RhythmKeep will always be available, uninterrupted, secure, or error-free, or that it will work with every device or operating-system version.
11. Disclaimer of warranties
To the fullest extent permitted by law, RhythmKeep is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, DonsonlineStoreLLC and its owners, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from RhythmKeep. To the fullest extent permitted by law, our total liability for all claims relating to RhythmKeep will not exceed the greater of fifty U.S. dollars or the amount you paid for RhythmKeep during the twelve months before the event giving rise to the claim. Applicable law may provide rights that cannot be limited by these terms.
13. Termination
You may stop using RhythmKeep at any time. We may restrict access if you materially violate these terms or when reasonably necessary to protect users, the service, or legal compliance. Sections that by their nature should survive termination will remain effective.
14. Governing law
These terms are governed by the laws of Florida, United States, without regard to conflict-of-law rules. Courts located in Florida will have jurisdiction, except where applicable consumer law requires otherwise.
15. Changes to these terms
We may update these terms as RhythmKeep evolves. We will post the revised terms here and update the date above. Continued use after updated terms take effect constitutes acceptance where permitted by law.
